AFRIK PLANET TERMS OF SERVICE

Welcome to Afrik Planet.

These Terms of Service (“Terms”) govern your access to and use of Afrik Planet, including our website at afrikplanet.com, mobile applications, features, services, communications, and other products that link to these Terms (collectively, the “Services”).

Afrik Planet is operated by Egrum LLC (“Afrik Planet,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Maryland, United States.

Afrik Planet is a global social networking platform designed to help people connect, communicate, share content, discover communities, and engage with people and cultures around the world. While Afrik Planet has a strong connection to African communities and the global African diaspora, Afrik Planet is open to people from all backgrounds and countries.

By creating an account, accessing, or using Afrik Planet, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Services.

Section 35 contains provisions governing how disputes are resolved, including the law that applies and where claims must be brought. Please read it carefully.

1. Eligibility

You must be at least 13 years old to use Afrik Planet.

If you live in a country that sets a higher minimum age for consenting to the processing of your personal data or for using online services, you must be at least that age. This includes, without limitation, a minimum age of 16 in countries of the European Economic Area and the United Kingdom that have set 16 as the applicable age of digital consent, and any higher age required by the law that applies to you.

If you are under the age of majority where you live, you may use Afrik Planet only with the involvement and consent of a parent or legal guardian, where that is required by the law that applies to you.

You must also be able to form a binding contract with us.

You may not use Afrik Planet if:

  • you are below the minimum age set out above, or below any higher minimum age required by applicable law;
  • you are prohibited by law from receiving or using our Services;
  • your account has previously been permanently disabled for serious or repeated violations of our Terms or policies, unless we authorize you to create another account; or
  • your use of the Services would violate applicable laws or regulations.

If we learn that a person under the applicable minimum age has created an account, we will remove that account. If you believe a child under the applicable minimum age is using Afrik Planet, please tell us at support@afrikplanet.com.

If you use Afrik Planet on behalf of a business, organization, or other legal entity, you represent that you have authority to accept these Terms on its behalf.

2. Your Afrik Planet Account

Certain features require you to create an account.

You agree to provide accurate information and keep your account information reasonably current.

You are responsible for maintaining the confidentiality and security of your login credentials and for activity conducted through your account.

You may not:

  • impersonate another person, business, or organization;
  • create an account using information you are not authorized to use;
  • sell, purchase, license, or transfer an account without our permission;
  • obtain or attempt to obtain another user's login credentials;
  • create accounts for deceptive, fraudulent, abusive, or unlawful purposes; or
  • use automated methods to create accounts unless expressly authorized by Afrik Planet.

You should notify us promptly at support@afrikplanet.com if you believe someone has gained unauthorized access to your account.

3. The Afrik Planet Community

Afrik Planet allows people from around the world to connect and interact through social networking features.

Depending on availability, these features may include:

  • user profiles;
  • photo and video posts;
  • short-form videos;
  • feeds;
  • stories;
  • comments and replies;
  • likes and other reactions;
  • reposts and sharing;
  • following users;
  • direct messaging;
  • voice and video communication;
  • live broadcasts;
  • groups and communities;
  • notifications;
  • search and discovery;
  • country and regional content discovery;
  • recommendations; and
  • other social and community features.

Features may change as Afrik Planet develops.

We may introduce, modify, test, restrict, suspend, or discontinue features when reasonably necessary to operate, improve, secure, or develop the Services.

4. Your Content

Afrik Planet allows you to create, upload, publish, transmit, display, or share photographs, videos, audio, text, comments, profile information, messages, and other materials (“User Content”).

You retain ownership of the User Content you create.

You are responsible for your User Content and must have the rights necessary to post, upload, or share it.

You represent that your User Content and your use of it through Afrik Planet will not violate another person's copyright, trademark, intellectual property, privacy, publicity, contractual, or other legal rights.

You are responsible for deciding what you share and with whom you share it.

5. License You Give Afrik Planet

You retain ownership of your User Content. However, we need certain permissions from you to operate a global social networking service.

When you upload, post, or share User Content through Afrik Planet, you grant Egrum LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, adapt as technically necessary, distribute, display, communicate, and otherwise use that content for the purposes of operating, providing, securing, improving, and promoting Afrik Planet and its Services.

This license does not transfer ownership of your content to Afrik Planet or Egrum LLC.

The license generally ends when your content is deleted from our systems, except where continued retention is reasonably necessary for backups, security, fraud prevention, legal compliance, dispute resolution, enforcement of our Terms, or where content has been shared by others in a manner that remains available through the Services.

6. Content Visibility and Privacy

Content you share may be public or limited to particular audiences depending on the feature and privacy settings available to you.

Some profile information or content may be visible to people who do not have an Afrik Planet account.

You are responsible for selecting appropriate audience and privacy settings.

Even when content is shared with a limited audience, other users may be able to save, screenshot, copy, record, or redistribute it.

Do not post or send information that you do not want others to see or potentially redistribute.

7. Prohibited Conduct

Afrik Planet is intended to provide a welcoming environment for communication, expression, creativity, and connection.

Afrik Planet has zero tolerance for objectionable content and for abusive users. Content and behavior described in this section are not permitted, and accounts responsible for them may be removed from Afrik Planet.

You may not use Afrik Planet to engage in unlawful, fraudulent, harmful, deceptive, threatening, or abusive conduct.

Prohibited conduct includes, but is not limited to:

  • threatening or promoting credible violence;
  • bullying, harassment, stalking, or targeted abuse;
  • hateful conduct or unlawful discrimination;
  • sexual exploitation or abuse;
  • exploitation, grooming, or endangerment of minors;
  • posting or distributing non-consensual intimate content;
  • posting sexually explicit or pornographic material;
  • gratuitously violent or graphic material;
  • human trafficking or exploitation;
  • fraud, scams, phishing, or deceptive schemes;
  • impersonating another person or organization for deceptive purposes;
  • distributing viruses, malware, or malicious software;
  • attempting unauthorized access to accounts, systems, networks, or data;
  • spam or coordinated platform manipulation;
  • artificially inflating followers, likes, views, comments, shares, or other engagement;
  • unauthorized bots, scraping, crawling, or automated activity;
  • violating copyrights, trademarks, or other intellectual property rights;
  • selling or promoting illegal goods or services;
  • encouraging or facilitating criminal activity;
  • unlawfully collecting personal information about other users;
  • interfering with the security, integrity, or normal operation of Afrik Planet; or
  • using Afrik Planet in violation of applicable law.

Additional requirements are provided in our Community Guidelines at afrikplanet.com/guidelines, which form part of these Terms.

8. Child Safety

Afrik Planet does not tolerate content or behavior that sexually exploits or endangers children.

We remove child sexual abuse material and accounts associated with it, and, as required by United States law, we report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC), which may share those reports with law enforcement.

We may preserve and disclose related account information to NCMEC or to law enforcement as permitted or required by law.

If you encounter content of this nature on Afrik Planet, report it immediately through the in-app reporting tools or at support@afrikplanet.com.

9. Photos, Videos, Audio and Other Media

You may upload photographs, videos, audio, and other media only when you have the legal right to do so.

You are responsible for obtaining any permissions or licenses that may be required from photographers, videographers, performers, copyright owners, or other rights holders.

You must also respect the privacy and legal rights of people appearing in your content.

Afrik Planet may process, resize, compress, transcode, crop, generate thumbnails or previews, or otherwise technically modify media as necessary to store, display, transmit, or deliver it across devices and networks.

Afrik Planet may also screen uploaded media and text using automated systems in order to detect content that appears to violate these Terms. See Section 18.

10. Music and Copyrighted Material

Posting something on Afrik Planet does not give you permission to use copyrighted music, photographs, videos, movies, artwork, written works, or other protected material.

You are responsible for obtaining any licenses or permissions required for material included in your User Content.

We may remove or restrict content that allegedly infringes copyright or other intellectual property rights.

We may restrict, suspend, or terminate accounts associated with serious or repeated infringement.

11. Copyright Complaints and DMCA Notices

Afrik Planet respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

11.1 Designated Copyright Agent

11.2 What a Notice Must Contain

To be effective, a notice of claimed infringement must be a written communication that includes substantially the following:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works;
  3. identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, the URL or the username and post);
  4. information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address;
  5. a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

11.3 Counter-Notification

If your content was removed or disabled and you believe this was the result of mistake or misidentification, you may send a counter-notification to our Designated Agent containing substantially the following:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled;
  3. a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, of any judicial district in which Egrum LLC may be found — and that you will accept service of process from the person who provided the original notice or an agent of that person.

If we receive a valid counter-notification, we may forward it to the person who submitted the original notice and inform them that we may restore the removed material in 10 to 14 business days. We may restore the material within that period unless the original complainant notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity.

11.4 Repeat Infringers

Afrik Planet maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright or other intellectual property rights.

12. Trademark and Other Intellectual Property Complaints

Complaints concerning trademarks, rights of publicity, or other intellectual property rights that are not copyright may be submitted to support@afrikplanet.com.

Please describe the right you hold, the basis for your claim, and where the material appears on Afrik Planet, and provide contact information for you or your authorized representative.

We may remove or restrict access to material and may take action against accounts that repeatedly violate the intellectual property rights of others.

Additional reporting procedures may be established on afrikplanet.com.

13. Messaging and Communications

Afrik Planet may provide direct messaging, group messaging, voice calling, video calling, or other communication features.

You may not use these features to:

  • harass, intimidate, or threaten people;
  • send fraudulent or unlawful communications;
  • distribute malware or phishing links;
  • repeatedly send unwanted messages;
  • send unlawful spam;
  • solicit illegal transactions;
  • exploit or endanger another person; or
  • otherwise violate these Terms or our policies.

Users should exercise reasonable care when communicating with people they do not personally know.

14. Live Broadcasts, Voice and Video Calls, and Recording

Afrik Planet may allow you to broadcast live video or audio, to invite other users to appear with you in a live broadcast, and to place voice and video calls to your connections.

Live broadcasts may be recorded. Afrik Planet may record a live broadcast, and any co-host or guest who appears in it, in order to make the broadcast available for later viewing, to enforce these Terms and our Community Guidelines, to investigate reports, to comply with legal obligations, and to keep the Services secure.

By starting, joining, co-hosting, or otherwise appearing in a live broadcast, you consent to being recorded by Afrik Planet and to that recording being stored and made available through the Services in accordance with these Terms and our Privacy Policy.

If you do not consent to being recorded, do not start, join, or appear in a live broadcast.

Other users may also capture, screenshot, screen-record, or otherwise reproduce a live broadcast or a call using their own devices or software, whether or not we permit it. We cannot prevent this. Do not say or show anything in a live broadcast or call that you would not want recorded and shared.

Recording another person without their knowledge may be unlawful in some countries, states, and provinces, and some jurisdictions require the consent of every participant. You are responsible for complying with the recording and privacy laws that apply to you and to the people you communicate with.

Voice and video calling on Afrik Planet is an internet feature, not a telephone service. It cannot be used to reach emergency services such as 911, 112, or 999, it does not connect to the public telephone network, it does not transmit your location to emergency responders, and it will not work without a working internet connection. Do not rely on Afrik Planet for emergency communications.

15. User Safety

Afrik Planet cannot verify every user, identity, statement, link, profile, or piece of User Content.

A profile, follower count, country flag, verification indicator, photograph, username, or other account information should not automatically be treated as proof of a person's identity or trustworthiness unless Afrik Planet specifically states otherwise.

Interactions that begin through Afrik Planet may result in communications, transactions, or meetings outside the platform.

You are responsible for exercising reasonable judgment when interacting with other users, particularly when:

  • sharing personal information;
  • sending money;
  • conducting transactions;
  • sharing your location;
  • communicating outside Afrik Planet; or
  • meeting another user in person.

16. Country and Regional Features

Afrik Planet may allow users to identify or select a country, region, language, community, or geographic interest.

Afrik Planet may also allow users to discover or filter content based on countries, regions, languages, communities, or interests.

A country flag, location, region, or similar indicator displayed on a profile or post does not necessarily represent citizenship, nationality, ethnicity, residence, heritage, or verified physical location unless Afrik Planet expressly identifies that information as verified.

Users may not use geographic, national, regional, or cultural features to deliberately deceive, defraud, or impersonate another person.

17. Feeds, Discovery and Recommendations

Afrik Planet may personalize, rank, filter, or organize:

  • feeds;
  • recommended posts;
  • videos;
  • stories;
  • suggested users;
  • search results;
  • trending content;
  • notifications;
  • advertisements; and
  • other content.

Our systems may consider signals such as accounts you follow, content you interact with, interests, language, country or regional selections, engagement activity, popularity, and other information.

Where we offer settings that let you limit how your activity is used to personalize your experience, those settings are described in the app and in our Privacy Policy.

The appearance or recommendation of content, accounts, products, businesses, or services does not constitute an endorsement by Afrik Planet or Egrum LLC.

18. Content Moderation

Afrik Planet may review, restrict, reduce distribution of, remove, or disable access to User Content when we reasonably believe that the content:

  • violates these Terms;
  • violates our Community Guidelines or other policies;
  • violates applicable law;
  • infringes another person's rights;
  • presents safety or security concerns;
  • involves spam, manipulation, or fraudulent activity; or
  • could expose Afrik Planet, Egrum LLC, users, or third parties to harm or legal liability.

We use a combination of methods to identify potential violations, including automated screening of images, video and text at the point of upload, human review, and reports submitted by users.

Afrik Planet is not obligated to review every piece of User Content before it is published, and automated screening will not identify every violation.

19. Reporting, Blocking and User Controls

Afrik Planet provides tools allowing users to:

  • report posts;
  • report comments;
  • report messages;
  • report accounts;
  • block users;
  • mute users;
  • restrict interactions;
  • hide content from particular accounts; or
  • otherwise control their experience.

We aim to review reports of objectionable content within 24 hours. Where we determine that reported content violates these Terms or our Community Guidelines, we will remove that content and may suspend or terminate the account of the user who posted it.

Blocking a user prevents that user from interacting with you through the features described in the app.

We encourage users to report content or behavior they believe violates our policies.

Submitting intentionally false, fraudulent, malicious, or abusive reports may itself violate these Terms.

20. Account Suspension and Termination

We may warn, restrict, suspend, disable, or terminate an account when we reasonably determine that the user:

  • violated these Terms or our policies;
  • repeatedly violated the rights of others;
  • engaged in unlawful activity;
  • created security risks;
  • engaged in fraudulent or deceptive activity;
  • created significant risks for other users or Afrik Planet; or
  • must be restricted because of a legal or regulatory requirement.

Serious violations may result in immediate suspension or termination.

Where appropriate or legally required, we may provide users with information about enforcement decisions or an opportunity to appeal.

You may stop using Afrik Planet at any time.

Where available, you may use account settings to deactivate or request deletion of your account. Following deletion, we may retain information for the limited purposes described in Section 5 and in our Privacy Policy.

21. Advertising and Sponsored Content

Afrik Planet may display advertisements, promoted posts, sponsored content, commercial recommendations, or other paid content.

Advertisements and sponsored content may be identified as such where required.

Advertisers are responsible for the claims, products, services, promotions, and offers contained in their advertisements.

Afrik Planet does not necessarily endorse a product, service, business, organization, or person merely because advertising or sponsored content appears on the platform.

22. Businesses, Brands and Creators

Afrik Planet may provide features for creators, businesses, brands, organizations, public figures, and professional users.

If and when we make them available, additional terms, policies, or eligibility requirements may apply to:

  • advertising;
  • commercial activities;
  • promotions;
  • branded content;
  • monetization;
  • business tools;
  • creator tools;
  • subscriptions;
  • payments; or
  • verified accounts.

Nothing in this section obliges Afrik Planet to offer any of these features.

If additional terms apply to a feature you choose to use, those terms become part of your agreement with us regarding that feature.

23. Third-Party Services and Links

Afrik Planet may contain links to third-party websites, applications, advertisements, products, payment services, or other resources.

We do not control third-party services.

Egrum LLC is not responsible for the availability, security, accuracy, content, products, privacy practices, or conduct of third-party services.

Your use of third-party services may be governed by separate terms and privacy policies.

If you download Afrik Planet from a third-party app store or platform, your use of the application may also be subject to that platform's terms.

24. Afrik Planet Intellectual Property

Except for User Content and third-party materials, Afrik Planet and its associated software, technology, interface, designs, graphics, logos, names, trademarks, branding, databases, and proprietary materials are owned by or licensed to Egrum LLC and protected by applicable intellectual property laws.

These Terms do not transfer ownership of Afrik Planet intellectual property to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Afrik Planet applications and website for your personal, non-commercial use of the Services.

Except where permitted by applicable law or expressly authorized by us, you may not:

  • copy or reproduce protected portions of the Services;
  • modify or create unauthorized derivative works;
  • sell, sublicense, or commercially exploit our technology;
  • reverse engineer protected software;
  • bypass technological restrictions;
  • misuse Afrik Planet trademarks or branding; or
  • falsely imply an affiliation with or endorsement by Afrik Planet.

25. Automated Access and Data Scraping

Unless we expressly authorize it, you may not use bots, crawlers, scrapers, scripts, automated tools, artificial intelligence systems, or other methods to access, extract, collect, reproduce, or systematically analyze Afrik Planet content or user information.

You may not use User Content obtained from Afrik Planet to create, train, develop, or improve artificial intelligence or machine-learning models without authorization from the applicable rights holders and Afrik Planet where required.

Search engines and other services may be permitted limited automated access when authorized by Afrik Planet.

26. Platform Availability

We work to keep Afrik Planet available and reliable, but we cannot guarantee uninterrupted operation.

The Services may occasionally become unavailable because of:

  • maintenance;
  • software updates;
  • technical problems;
  • telecommunications failures;
  • security incidents;
  • infrastructure failures;
  • third-party service interruptions; or
  • circumstances outside our reasonable control.

We may modify or discontinue portions of the Services subject to applicable law.

27. Beta and Experimental Features

Afrik Planet may provide beta, preview, experimental, or early-access features.

These features may contain errors, operate differently than expected, change substantially, or be discontinued.

Unless applicable law provides otherwise, experimental features are provided without guarantees regarding their performance or continued availability.

28. Privacy

Your privacy is important to us.

Our collection, use, processing, storage, and sharing of personal information is governed by the Afrik Planet Privacy Policy, available at afrikplanet.com/privacy, and by applicable law. The Privacy Policy forms part of these Terms.

Our Privacy Policy describes how we handle information such as:

  • account and profile information;
  • content and interactions;
  • photographs and videos;
  • messages and communications;
  • live broadcasts and call records;
  • device and browser information;
  • IP addresses;
  • country or regional selections;
  • approximate or precise location where applicable and permitted;
  • cookies and similar technologies;
  • advertising information;
  • analytics;
  • security information; and
  • other information generated through your use of Afrik Planet.

By using Afrik Planet, you acknowledge that you have been provided access to our Privacy Policy.

29. International Users, Export Controls and Sanctions

Afrik Planet is designed to serve a worldwide community.

Users may access Afrik Planet from different countries and jurisdictions with different laws governing privacy, consumer protection, online content, communications, intellectual property, and digital services.

Afrik Planet is operated from the United States, and information you provide may be transferred to, stored in, and processed in the United States and in other countries where we or our service providers operate.

You represent that you are not located in, and are not a national or resident of, any country or territory subject to comprehensive United States trade sanctions or embargoes, and that you are not listed on any United States government list of prohibited or restricted parties. You may not use Afrik Planet in violation of United States export control or sanctions laws.

You are responsible for complying with laws applicable to your use of Afrik Planet.

Nothing in these Terms is intended to remove privacy, consumer, or other statutory rights that cannot legally be waived under the laws applicable to you.

30. Feedback and Suggestions

We welcome feedback, ideas, and suggestions about Afrik Planet.

If you voluntarily provide us with feedback or suggestions regarding our Services, you permit us to use that feedback to develop, improve, promote, or operate Afrik Planet without compensation or obligation to you, unless otherwise agreed in writing.

This provision does not give us ownership of your User Content.

31. Electronic Communications and Notices

By using Afrik Planet, you consent to receive communications from us electronically, including in-app messages, push notifications, and email sent to the address associated with your account.

You agree that notices, disclosures, agreements, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

You may control certain notifications through your account settings, but we may still send you communications that are necessary to operate your account, protect security, or comply with law.

You may send notices to us at support@afrikplanet.com or at the postal address in Section 40.

32. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AFRIK PLANET AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

EGRUM LLC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND OTHER WARRANTIES TO THE EXTENT PERMITTED BY APPLICABLE LAW.

WE DO NOT GUARANTEE THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE;
  • THE SERVICES WILL BE COMPLETELY SECURE;
  • THE SERVICES WILL BE ERROR-FREE;
  • ALL USER CONTENT WILL BE ACCURATE;
  • EVERY USER IS WHO THEY CLAIM TO BE; OR
  • CONTENT OR INFORMATION AVAILABLE THROUGH AFRIK PLANET WILL ALWAYS BE RELIABLE.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

33. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EGRUM LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF AFRIK PLANET.

This includes, where legally permitted, losses involving:

  • data;
  • User Content;
  • revenue;
  • profits;
  • business opportunities;
  • reputation;
  • relationships; or
  • unauthorized access to an account.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

34. Indemnification

To the extent permitted by applicable law, if you use Afrik Planet for business or commercial purposes, you agree to defend, indemnify, and hold harmless Egrum LLC and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • your unlawful use of Afrik Planet;
  • your material violation of these Terms;
  • your User Content; or

Any indemnification obligation is subject to applicable law.

35. Governing Law, Venue and Disputes

These Terms, and any dispute or claim arising out of or relating to these Terms or your use of Afrik Planet, are governed by the laws of the State of Maryland, United States, and by applicable United States federal law, without regard to conflict-of-law principles.

You and Egrum LLC agree that any claim or dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Prince George's County, Maryland, United States, and you and Egrum LLC consent to the personal jurisdiction of those courts.

Because Afrik Planet serves users worldwide, users may have mandatory rights under the laws of their state, province, country, or jurisdiction. If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings in your local courts or to rely on your local consumer law, nothing in this section removes that right.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@afrikplanet.com. If a dispute is not resolved within 60 days of that notice, either party may begin formal proceedings.

36. Changes to These Terms

Afrik Planet will continue to evolve.

We may update these Terms to reflect changes to:

  • our Services;
  • features;
  • technology;
  • policies;
  • business practices;
  • security requirements; or
  • applicable laws and regulations.

When changes are material, we will provide notice as required by applicable law. Notice may be provided through Afrik Planet, by email, on afrikplanet.com, or through another reasonable method.

The updated Terms will identify their effective date.

Your continued use of Afrik Planet after updated Terms become effective may constitute acceptance of those Terms where permitted by applicable law.

If you do not agree to updated Terms, you should stop using the Services and may request deletion of your account.

37. Severability

If a court or other authority determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will continue in effect.

38. No Waiver

If Afrik Planet or Egrum LLC does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce that provision later.

39. Entire Agreement

These Terms, together with the Afrik Planet Privacy Policy, Community Guidelines, and any supplemental terms or policies expressly incorporated into these Terms, constitute the agreement between you and Egrum LLC regarding your use of Afrik Planet.
